As more countries recognize same-sex marriage, more LGBTQ+ couples are able to build the family they’ve always dreamed of. However, for couples who want to have children, the journey can still be challenging.

Many same-sex couples face legal restrictions or limited fertility options in their home countries. Fortunately, some countries, including the United States, allow same-sex couples to build their families through egg donation, sperm donation, and gestational surrogacy. California is one of the most popular destinations because of its supportive laws and advanced medical care.

In this article, Sunlight Surrogacy Consultant Center explains how same-sex couples can legally have a child through surrogacy in the United States.

Can Same-Sex Couples Legally Use Surrogacy?

In many countries, same-sex marriage is legal, but surrogacy is still restricted or not clearly regulated.

California is one of the few places where same-sex couples can legally pursue surrogacy. With experienced fertility clinics, strong legal protections, and clear parentage laws, California has become one of the top choices for LGBTQ+ families around the world.

How Does the Process Work?

The surrogacy journey for same-sex couples in California usually includes the following steps.

1. Initial Consultation

The first step is a consultation to understand your situation and discuss your family-building goals.

For male couples, an egg donor is usually needed.

For female couples, donor sperm may be required.

2. Medical Checkups

Before starting treatment, you will complete basic medical testing in Taiwan. These tests evaluate sperm or egg quality, overall health, infectious diseases, and family medical history to make sure everything is ready for the next step.

3. Choose a Fertility Clinic in the United States

Our team will recommend experienced fertility clinics with high success rates.

You can either travel to the U.S. for sperm or egg retrieval, or complete the procedure in Taiwan and safely transport your samples to the United States.

4. IVF and Genetic Testing

The fertility clinic will perform 體外受精 to create embryos.

Most clinics also recommend PGT-A (formerly PGS) to check the chromosomes before embryo transfer. This helps select healthy embryos, lowers the risk of miscarriage, and improves the chance of a successful pregnancy.

5. Match with a Surrogate

Choosing the right surrogate is an important step.

A professional surrogacy agency carefully screens every surrogate through medical, psychological, and background evaluations. You’ll also have the opportunity to meet your surrogate through an online interview.

The surrogacy agreement clearly explains surrogate compensation, medical expenses, insurance coverage, and each party’s legal rights and responsibilities.

6. Embryo Transfer

Once everything is ready, the selected embryo is transferred to the surrogate’s uterus.

About two weeks later, the clinic will confirm whether pregnancy has been achieved. Around 12 weeks into the pregnancy, doctors will check that the baby’s heartbeat is healthy and stable.

7. Pregnancy Management and Legal Preparation

Throughout the pregnancy, the surrogate attends regular prenatal appointments.

Your case manager will stay in close contact with the surrogate and provide regular updates, allowing you to follow the pregnancy even while living overseas.

During this time, legal professionals will also prepare the necessary documents to establish your parental rights before your baby is born.

8. Welcome Your Baby

As the due date approaches, your surrogacy team will help arrange your travel to the United States so you can be there to welcome your baby.

They will also assist with the baby’s birth certificate, passport, and any documents needed for returning home.
